Welcome to Tashumove. These Terms and Conditions ("Terms") govern your access to and use of the Tashumove platform, including our website, mobile applications, and related services. By using the platform, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the platform.
1. Eligibility
1.1 You must be at least 18 years old to create an account and use the platform.
1.2 Drivers must:
- hold a valid and current Australian driver's license;
- maintain any insurance required under law;
- meet any eligibility requirements communicated by Tashumove.
1.3 Customers must:
- have the legal right to authorize the relocation of the vehicle;
- ensure the vehicle is legally registered and roadworthy.
1.4 By creating an account, you warrant that you meet all eligibility requirements.
2. Our Services
2.1 Tashumove provides a digital platform that:
- connects customers requiring vehicle relocation with drivers willing to perform relocation jobs;
- facilitates booking, communication, and payments;
- provides tools for driver verification, route tracking, and job reporting.
2.2 Tashumove is a technology facilitator only. We do not own or operate vehicles, and we are not a transport provider.
2.3 Users (drivers and customers) are solely responsible for their interactions, compliance with law, and insurance.
3. User Accounts
3.1 To use most features, you must create an account. You agree to provide accurate, current, and complete information.
3.2 You are responsible for maintaining confidentiality of your login details.
3.3 Any activity under your account is your responsibility.
3.4 Tashumove reserves the right to suspend or terminate accounts for:
- fraudulent activity;
- providing false or misleading information;
- breaches of these Terms; or
- unlawful use of the platform.
4. Driver Obligations
4.1 Drivers must:
- comply with all applicable Australian road laws, including the Road Transport Act 2013 (NSW) and the Australian Road Rules;
- not drive under the influence of drugs, alcohol, or impairing substances;
- accurately log vehicle condition using pre- and post-trip reporting;
- complete assigned jobs professionally and safely.
4.2 Drivers must maintain at their own cost:
- valid insurance (e.g., compulsory third party, comprehensive, or as otherwise required);
- updated licenses and permits.
4.3 Drivers acknowledge that customers and vehicle owners may make claims if damage, loss, or delay occurs.
5. Customer Obligations
5.1 Customers must:
- provide accurate details (vehicle make, model, registration, and relocation instructions);
- ensure vehicles are roadworthy, legally registered, and free of defects preventing relocation;
- disclose any known risks or special requirements to drivers.
5.2 Customers are responsible for ensuring insurance coverage applies to relocation jobs.
6. Payments, Fees, and GST
6.1 Customers agree to pay fees at the time of booking.
6.2 Payments are processed through third-party providers who comply with PCI-DSS standards.
6.3 Drivers receive payouts after completion of jobs, subject to Tashumove's service fees.
6.4 All fees include Goods and Services Tax (GST) in accordance with the A New Tax System (Goods and Services Tax) Act 1999 (Cth).
6.5 Tashumove may adjust fees for cancellations, disputes, or corrections.
7. Cancellations and Refunds
7.1 Customers may cancel jobs:
- prior to driver assignment, with minimal penalty;
- after driver assignment, subject to cancellation fees.
7.2 Drivers may cancel in emergencies but repeated cancellations may lead to suspension.
7.3 Refunds will be provided where required under the Australian Consumer Law (ACL).
8. Prohibited Use
You must not use the platform to:
- violate Australian law (criminal, traffic, or consumer laws);
- harass, threaten, or defraud other users;
- bypass safety, identity verification, or payment systems;
- upload or distribute viruses, malware, or harmful code;
- engage in activity that damages Tashumove's reputation.
9. Intellectual Property
9.1 All software, branding, trademarks, and content belong to Tashumove or its licensors.
9.2 Users are granted a limited, non-exclusive, revocable license to use the platform for lawful purposes.
9.3 You may not copy, reverse-engineer, or commercially exploit any part of the platform.
10. Privacy and Data Protection
10.1 Tashumove handles personal data in compliance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
10.2 Drivers consent to background GPS location collection while jobs are active.
10.3 Tashumove complies with the Notifiable Data Breaches (NDB) scheme and will notify affected users and the OAIC in the event of a serious breach.
11. Cookies and Tracking
11.1 We use cookies, SDKs, and tracking technologies for:
- service functionality;
- remembering user preferences;
- analytics and performance;
- fraud prevention and safety.
11.2 Third parties (analytics, maps, crash reporting) may also set cookies.
11.3 By using our platform, you consent to cookies in line with our Privacy Policy.
12. Marketing and Communications
12.1 We comply with the Spam Act 2003 (Cth).
12.2 You may receive emails, SMS, or in-app notifications relating to service updates or promotions.
12.3 You can opt out of marketing communications at any time.
13. Consumer Rights
13.1 Nothing in these Terms excludes rights under the ACL.
13.2 If our services fail to meet consumer guarantees, you are entitled to remedies under the ACL.
14. Liability and Disclaimer
14.1 To the extent permitted by law:
- Tashumove is not liable for theft, loss, or damage to vehicles during relocation;
- Customers and drivers are responsible for arranging appropriate insurance;
- We exclude liability for indirect or consequential losses (e.g., loss of profits).
14.2 The platform is provided "as is". We do not guarantee uninterrupted access, error-free operation, or virus-free software.
14.3 Nothing in these Terms limits liability under the ACL.
15. Indemnity
You agree to indemnify Tashumove, its directors, and staff from claims, costs, or damages arising out of:
- your use of the platform;
- your breach of these Terms;
- disputes between drivers and customers.
16. Termination and Suspension
16.1 Tashumove may suspend or terminate access for:
- breach of these Terms;
- unlawful or unsafe conduct;
- regulatory requirements.
16.2 Users may close accounts by written notice to Tashumove.
17. Governing Law and Disputes
17.1 These Terms are governed by the laws of New South Wales, Australia.
17.2 Any disputes must be resolved in the courts of NSW.
18. Amendments
18.1 Tashumove may update these Terms from time to time.
18.2 Changes will be published on the platform with a revised effective date.
18.3 Continued use after updates constitutes acceptance.
19. Website Disclaimer
- Information on the website is provided for general purposes only.
- We make no warranties about accuracy, reliability, or completeness of content.
- Tashumove disclaims liability for any loss from reliance on website information.
- We do not guarantee continuous availability of the platform.
